Fees

Our fees cover all of the work required to complete the sale and or purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England or Land Transaction Tax (Land Tax) if the property is in Wales. A typical freehold property will likely take between 6-12 weeks to complete, however this will depend entirely on the complexity of your matter and co-operation of third parties.

Our professional charges are based on the following presumptions:

  • The property is currently held under a single freehold title at the Land Registry with no title defects, building regulation or planning issues;
  • You are an individual and are not instructing us to conduct the transaction as a personal representative, executor or a director on behalf of a limited company;
  • One contract is submitted to one purchaser;
  • The purchase will be on the basis of an unconditional contract and the property is acquired with vacant possession;
  • We are instructed by individual persons and not a mortgagee in possession, attorney, executor, personal representative, director or company secretary acting on behalf of a limited company;
  • Completion takes place on the date agreed in the contract;
  • The purchase monies, except for any mortgage advance, are provided by you and there are no gifts, ISA bonuses or contributions from third parties;
  • There is to be no more than one financial charge or restriction to be registered against the property and no more than one mortgage lender whom we are required to act for or provide undertakings to;
  • The mortgage lender is a main stream lender who only requires us to follow instructions which appear in the Council of Mortgage Lenders Handbook, uses a standard mortgage as per IB 3.7 of the SRA Code of conduct 2011 and the certificate of title required by the lender is in the form approved by the Law Society and the Council of Mortgage Lenders;
  • You are not taking part in a contract race and the purchase does not have to be expedited towards exchange because of auction terms or other conditions imposed by either you or the seller;
  • There are no other complicating issues affecting the property such as shared ownership, stair-casing, solar panels, leases of roof space or a loan attaching to the property under the "Green Deal";
  • All Persons are able to attend our office to provide identification documentation and sign the contract, transfer deed, mortgage deed, and any other documents as required in the transaction.

Stamp Duty

Disbursements

Disbursements are costs relating to your matter that are payable to third parties, such as Land Registry fees, ID checks, search fees, bankruptcy searches and Stamp Duty. We handle the payment of the disbursements on your behalf to ensure a smoother process. Third party disbursements are fees that are not governed by us and will be included in your quotation.

  • Land Registry Registration Fee: ranging from £20.00 up to £540.00 depending upon the purchase price of the property - details will be provided within the client care letter
  • Land Registry Priority Search: £3.00 per title number being purchased
  • Bankruptcy Search: £2.00 per name
  • Local Authority Search Water and Drainage Search and Environmental Search £178.40 (mandatory if you are taking out a mortgage)
  • Online ID check: £7.74 per client
  • Stamp Duty Land Tax: This is based upon the purchase price and your circumstances and details will be provided within the client care letter
Sales
  • Copy deeds: £3.00 per document (minimum of 2 required)
  • Online ID check: £7.74 per client

Additional Fees

The professional charges listed will vary from property to property and can on occasion be more than the ranges given above. Some transactions may require more legal work than that which was originally anticipated and included in your estimated quotation. Such additional work and charges will be discussed with you if anything unforeseen arises during the transaction. Additional fees may stem from work required in respect of Help-to-Buy ISA's, Deed of Covenant, Statutory Declaration, Transfers of Equity, New Build Fee and Gifts contributed to the purchase price or any issues which fall outside the list of presumptions, above. In rare cases unexpected developments may make the transaction more complicated than expected and this may entail additional fees.

Additional fees may also arise from third party referrers, who's terms you will have agreed to separately.

The professional charges listed in the table above assumes a single conventional residential freehold transaction. If the property subsequently transpires to be leasehold, we will charge a supplement of £125+VAT to cover the extra legal work involved.

Probate

We understand that many people put off the often difficult task of future planning. At Nick Brundall Solicitors we are committed to ensuring all our clients make the necessary arrangements to ensure their assets and belongings pass to their loved ones. It is inevitable that no two estates will be the same, however the administration of most estates usually takes between 6 to 12 months to complete.

Grant Only Probate Matter

We offer a fixed fee for a Grant Only probate matter if you wish to conduct the administration of the estate yourself, provided that certain criteria are met. The exact cost will depend on the individual circumstance of the matter. We estimate that the professional charges will be £450+VAT and disbursements*. Probate can be granted within 3 months; however, a third party government body deals with this application so time frames are at their discretion.

Full Estate Administration

Further to the above, you may prefer to instruct us to administer the full estate on your behalf which will include obtaining Grant of Representation, locating all assets and liabilities and distributing to beneficiaries. We anticipate that a straightforward estate administration that is not contested, where all of the assets are in the UK and there is a valid will, will likely take between 6-12 months to complete and will be chargeable at an hourly rate (see below). Professional charges will be determined entirely by the amount of time spent dealing with your matter and will be discussed with you in an initial appointment.

Professional Charges

Our hourly rate fees range from £111 - £220 per hour, depending on the seniority and experience of the solicitor or legal executive looking after your case.

Our charges are likely to be in the region of £1,000 - £3,000. A simple estate, e.g. a freehold property with a few bank accounts and one beneficiary will be approximately £1,000-£1,500. If the estate is more complex e.g. has various bank accounts, investments and shares or has multiple beneficiaries, our fees will be approximately £3,000. All estimated charges are circumstantial and will be discussed with you in your initial appointment.

We understand that not all our clients can make it in to our office and when necessary, we are happy to arrange a home visit. Home visit charges start from £50+VAT within a 5-mile radius of our office.

Disbursements

Disbursements are costs relating to your matter that are payable to third parties, such as Court Fees, Land Registry fees, bankruptcy searches, Commissioner of Oath fees and if you require additional copies of the Grant of Representation. We handle the payment of the disbursements on your behalf to ensure a smoother process. Third party disbursements are fees that are not governed by us and will be included in your quotation.

*Disbursements are likely to include:

  • Court Fee: £155
  • Oath Fee: £5-7 per person
  • Bankruptcy Search Fee: £2 per beneficiary
  • Additional copies of the Grant of Representation: £0.50p per copy
  • Land Registry Search Fee: £3
